The applicant requests review and recommendation of a Development Code amendment to Chapter 12- Development Standards. The amendment seeks to make the standards for Bed and Breakfasts consistent with the proposed changes to the residential table of uses.

Specifically, the R-1-22 zone was included as a possible zone for Bed and Breakfasts to be approved as a conditional use. Before the proposed change, the Code allowed for them only in the A-5, A-1, and RA-1 zones. Typically, R-1-22 lots are larger than RA-1 due to the minimum lot size requirements. Staff feels that this amendment should have minimal impact and would make the Code more consistent overall.

    Thank you for the question. The current requirements for Bed and Breakfast can be found in Section 12.230 of the Development Code. While there is not a specific number of potential occupants listed, they are always a conditional use in residential zones which would allow the Planning Commission to place limits on the number of people that can be served. The Planning Commission could also place conditions on the hours of operation and typically does so. The use is required to comply with State and Fire Code requirements. Additionally, the owner or an employee must be present at all times. For parking, we require 1 stall per each sleeping unit plus one stall for each employee present during regular hours.

    There is a restriction that makes it so a B&B cannot be located within 600 feet of a school. The location you specifically mentioned would not be allowed to have a B&B because they fall within 600 feet of Willow Creek Middle School. Let us know if you have any other questions!
