The Planning Commission approved this item.
The McBride's want to place an eight-foot fence at their house at 370 East 500 North.
All fences greater than six feet in height require a conditional use permit. The applicant provided an aerial map showing where the eight-foot fence will be installed. It is located along the south property line for 60 feet and runs along the southeast property line for an additional 20 feet. The applicant’s narrative states that this fence is meant to help appease concerns about vehicles from their home occupation being parked in the backyard.
The fence meets all of the Code requirements for site distance. Eight foot fences require a building permit to make sure they are structural sound.
Conditional uses are allowed uses by Utah State Code. The Planning Commission can put reasonable conditions on the fence to mitigate against potential harm. Public comments focused around the potential negative impacts of the fence and any adjustments that could be made are helpful to the Commission. Opposing the fence cannot lead to its denail unless evidence for legitimate health, safety or welfare concerns are provided.
