The applicant wants to amend the Lehi City Development Code Section 24.030. Currently legal non-conforming uses (uses that were allowed but no longer meet zoning requirements) cannot expand their land area. The applicant wants to change that to allow for an expansion of parking. Their proposed language says that if they are next to a vacant lot, they can expand their parking up to 30% of the previous land area.

While I'm not opposed to the expansion request, it appears prima facie the proposed development code amendment is written to facilitate a single, very specific use case. I request the council consider future impact/application of the amendment, should it be approved.

Is the council prepared to accept future amendments to the "parking lot" clause, expand or reduce the 30% threshold?

Will the original Section 04.060. Criteria for Approval requirements still apply to legal non-conforming expansions under this proposal, more specifically...parking lots?

I would recommend denial of the proposed amendment as currently written, as it appears to be a workaround for what should be done via re-zoning to allow the dealer to expand their footprint.
