This proposed preliminary plat includes the J1 and L1 areas with a total of 143 units per acre. The Traverse Mountain Area Plan allows a lot of flexibility with this site. The Area Plan dictates a maximum number of units, but allows flexibility in the actual number.

The applicant had a previously approved concept plan that included J1.

This is an administrative item which means that if it meets the Code the Planning Commission and City Council have to approve it. This does meet the Code. They are asking for one exception to connectivity but they warrant the exception based on the slope and existing development.

The public can still make comments. Comments focused on Code that they feel have not been met and suggestions for the developer are the most helpful. The public should recognize that they cannot get this project denied but can try to work with the developer to gain the most optimal outcomes.

    There are only 143 townhomes total. The density is 5.8 units per acre.

    The City has standards for emergency access and this meets those. Because Fox Canyon is the only access road for this area it includes two lanes in both directions to allow for more access during emergencies. This was approved as part of the Area Plan and the overall subdivision plan.

    This is not anticipated to add a significant amount of traffic to the TM Elementary 4-way stop (Traverse Mtn Blvd @ Chapel Ridge Rd). These townhomes will only add 70-85 total trips to the roadway network in the peak hours, that is less than two a minute, on average. On top of that, only a portion of these will go through this intersection.

    Many of the HOA's stay under developer management until all of the homes are sold, this is usually outlined in the CC&Rs. The HOA does not review and approve plans. The City approves them based on if they meet the Code and the Traverse Mountain Area Plan requirements.

    Thank you for your concern. Fox Canyon Road includes a wider road width in consideration of emergency evacuation situations. This was considered when the Area Plan was adopted showing the density in this area as well as the units that have already been built further up.

    They will either need to provide sprinklers in the townhomes or a 30 foot landscaped buffer. The Lehi City Fire Marshal reviews the plans to make sure they meet fire code requirements.

    All new developments pay connection and impact fees. These fees include: culinary and irrigation water, sewer, storm drain, sewer treatment, transportation, parks and recreation, fire/EMT, police, and power.

    The City can only require new developments to provide impact fees, land, parks, beautification that is directly related to the impact of their project. Requiring more than their impact requires payment by the City or else it is considered a "taking" of private property rights.

    The Area Plan specifies that they can be 45 feet or 3 stories tall

    The school district works separately from the City. There is coordination but both entities are separate. This new development will help pay for existing and future schools through property taxes.

    Yes they will be a part of the master HOA as outlined in the CC&Rs. This is an approved part of the existing area plan.
