The applicant has an existing 8 foot art wall fence in his yard. He was unaware of the need to apply for a conditional use permit for fences above 6 feet in height. This is his request for approval of his art wall.
The Planning Commission must approve conditional uses as long as conditions can be placed upon the use to mitigate against potential nuisances. The Commission may only deny the conditional use if there are significant impacts to health safety and welfare based on facts. Conditional use applications include public comment so people living around the use can provide input on potential nuisances and conditions that could mitigate against these nuisances. Comments arguing against allowing the use will not lead to a denial unless they include data driven health, safety or welfare concerns.
The applicant's wall is outside of the clear sight area designated by the Development Code to prevent safety risks to drivers and pedestrians from large fences obstructing the road or driveways. This fence starts far enough back that it does not appear to create an obstruction to the sidewalk or road.
