Consultation has ended. This item will be scheduled for City Council on June 11, 2024.

Staff recommends amending Chapter 11 and Figure 15 of the Development Code to adjust and clarify the approval process for two-lot subdivisions with an existing home. The proposed code amendment would remove the requirement that they require approval by the Planning Commission and make it a review and approval by the Reviewing Departments. However, if the project were a flag lot it would still need conditional use approval. Oftentimes the two applications (two-lot subdivision with an existing home and conditional use for a flag lot) have been heard together with separate motions for each item at Planning Commission. This code amendment will still give the public the opportunity to comment on any potential negative impacts during a public hearing for the conditional use permit.

Additionally, the update to Figure 15 is just to clearly show the timeline of approval.

During an internal staff meeting, Engineering staff requested that an addition be made to another section of Chapter 11 to clarify that bonds may be accepted from banks outside of Utah.
